* the victim suffers loss of money and/or property as a result of relying upon and acting upon the untrue representation.

That has to be true for it to be fraud doesn't it?

What if the minor DIDN'T receive what he ordered?

And he declined later in the process?
Or he/she confessed to fraud (Which means the 'victim' did not rely on the false representation, knowing that it is false...

And What would a minor be charged with for fraud?

Yes. He could also be charged with other things depending upon what he ordered and if he received it.

It depends, im assuming that you have a fake i.d and trying to buy alchohol becasue that is usually the case.

I have a fake i.d, but on the back it says "this i.d is for personal use only and is not a federally recognized form of identification."

this clears you of any fraud because it basicly says its a fake i.d, so that way you're not lying.

I guess thats my situation though lol, my name and everything else is the same and ive been using it for liqour stores for 2 years and i havent gotten in trouble.

wont have to in 9 months because i'll be 21!!!

So i guess thats the only siutation where it isnt fraud

if you had no intention of getting the items, then why did you fill the form out and provide false/fake information about the date of birth.
burden of proof is easy to show that there was intent all along.

Yes, it's fraud. If items are sent to be received, then intention doesn't matter.

fraud is a misrepresentation with the intent to deceive and the purpose of gaining something

Yep, it's fraud.

He knows his real age, so submitting anything other than his real age is committing a fraud.

Now if he didn't know his age, then that would just be a mistake, and who would believe you don't know your own age.
