last year in july, i had a car accident and crashed into my "friends", that same night we filed an INCIDENT report which stated that they did not claim any injuries and that we were going to handle everything among ourselves, the police decided not to file police report/accident report, just an incident one. Yesterday I got a paper saying that my "friends" were going to end up sueing me for more than 100,000 because of injuries, repairment of i dont know what, and for them not going to work! is it possible for them to come back and sue me after we had said we were going to solve everything among ourselves and no accident report was filed? Im totally confused! they did sue the insurance company, we have the same one!

Yes, they can indeed do what they are doing. They can sue you. They may win. I suggest you go see an attorney. You will have problems that are a bit unique since you both use the same insurance company. Also, contact the insurance company and let them know you are being sued.

People are hurt all the time and don't realize it right away. I'm not saying this happened in your case, but I have represented many people who didn't realize they were hurt for a day or so. several of these have even had to have surgery because of the injuries. One even had internal bleeding and didn't realize it until the next day.

As far as having the same insurance company that is a common occurrence and won't make any difference.

Don't worry too much about the dollar figure they are claiming. It is just a starting point.

Yes they can sue. Anyone can sue. However your lawyer is going to present the incident report as evidence. Add to that they'll have to show why they waited nearly a year to claim injuries after saying they had none and I think you'll stand a good chance of winning the case. Your lawyer may also suggest a counter-suit. Just because you hit them doesn't mean that you won't be able to sue, and possibly win a settlement.

David, yes they can. I have handled thousands of cases just like that.
A lawyer gets involved and sends them to a "doctor" to get checked out just to make sure they are not injured (even though they don't think they are).
He decided they need physical therapy and time off work.

Keep in mind that the more medical expenses and lost wages they run up, the more money they stand to get from a jury and the more the atty will get.

Make sure you report this accident to your insurance company immediately.

95 percent of these cases are settled by the insurance company before any trial. In fact, most don't even go to to trial, just handled between the atty and ins co.

Unfortunately we can get sued by almost anyone for anything at anytime.
There are also time limits that they can sue you.
Let your insurance company handle this if you have full coverage.
I'm sure you can file for personal bankruptcy, it is harder now, but still possible ( I'm not sure of your financial situation )
Get A lawyer, if you don't have full coverage insurance.

Wow how I love the honesty in America. People are greedy "F's" get a lawyer.
People are so corrupt and lazy these days it's ridiculous.
