My sister in law got a debit card and last month she was out of money to pay her bill and end up using the debit card from Child Support.. Child Support called her and did not give her the next check she was suppose to get cause they noticed she used it to pay a bill and not to take care the kids... I wanted to know if this is the reason why they are doing it....

She was told that she's not allow to pay bills such as electric, car, rent, insurance etc.. that even if she didn't have a kid she would have to pay for this things with her own money.. that they money is to pay food, child care, clothing, medical bill for the kids, etc...

That doesnt make any sense...because you can use child support to pay a bill....(utilities, or something you spent on the child), there fore you can use the card the same way...that's the way it is designed...it is a mastercard/debit card

The purpose of child support is to provide for the needs of the child. The needs of the child are not limited to direct expenses for food, clothing, school and entertainment. Child support is also to be used for housing, utilities, transportation, and other indirect expenses related to the day-to-day care and well-being of the child.

Courts have held that it is acceptable for child support payments to be used to indirectly benefit the custodial parent. For example, child support monies may be used to heat the child's residence, even if this means that other people also benefit from living in a heated home

The expenses of raising a child include food and clothing, housing, utilities, medical expenses, transportation, education, childcare, extra-curricular activities and more.

OK...NOW...child support is used for raising the child just as if the couple were still together......would you not pay for soccer or the lights or gas for the car if you were still together????

They shouldn't. They are ignoring a court order and they should have no right to view her debit card purchases. By not giving her the money. That just hurts the child. The whole thing does not have to go to the child. Paying electric, house, gas, and phone bills is considered in most states supporting the child. Even I was the Judge and heard this I would be ticked off.

I would actual file a complaint with the bank that issues the card and the state bank commission and the attorney general viewing these purchase possibly violates state and Federal law.

You may want her to contact her divorce lawyer about this.

What kind of bill was she paying? It must have been a pretty big bill for them to not give her next full cheque. They wouldn't have done this if it was a utility bill because some of the money goes for their living expense which includes utilities. So either there is a mistake on the bill she paid which wasn't for the kids or the Child Support people did not realize this was a utility bill because it was so high!! Your sister-in-law should call them up and clarify this with them, it could just be a communication mix-up. Child Support is exactly for that (the child) your sister-in-law is not a child.

I don't understand this: Things like utilities are essentials for both your sister-in-law and her children. But child support is state-specific. You should consider visiting http://www.childsupportweb.com to find links to the child support agency in your state.

That is good! Child support is called Child Support for a reason, it is not alimony or anything like that. Maybe she learned her lesson

What state are you in? This doesn't sound right? I would check into this a little deeper.
