We have a piece of land that has several easements in order to get to it. We recently tried to sell it - we had a buyer, but the buyer's title company could not 'find' all of the easements, so it fell out of escrow.

The problem is, when we originally bought the land, our title company 'found' and insured all the easements.

If our title company (when we bought the place) screwed up, how can we go about getting retribution from them? Can we force them to get all the easements? Can we force them to buy the land?

Assuming you retained a copy of your title policy when you purchased the land, all the easements should be described therein. Perhaps the BUYER'S title company was the one who was less than competent here ?

Do check it out before you start considering any legal action. Your best course of action is to contact your title firm and ask for a copy of your policy, if you no longer have your copy. You may well find that all the easements are there.

Your title insurance should cover it. If your title company issued title to the property, then they should be able to get with the buyers title company to show them the original title work. This really shouldn't be a big deal. It'll be able to be worked out, this is exactly what title insurance is for. If the buyers title company still won't issue clear title, switch companies and have YOUR title company issue the policy.

You can't force anyone to buy your property. It just doesn't work that way.

Wow that's a sticky situation. I don't think you should rely on answers you get in here. You should seriously consult a Real Estate Attorney in your area.
