After she got sick he called and wanted me to come and get her because he could not take care of her. he has not provided any financial means of helping take care of her and he retired from the military, I just found out he passed away 4 days ago. No one called my mothers family or my mother. My question is is she entitled to anything?

If they were still legally married, then yes - I can't see how she would not legally be the sole beneficiary of their estate as well as any debts. Hope he didn't have too many debts and I hope your mom gets well soon!

Perhaps a small death benefit. Beyond that I doubt it. Call the VFW post nearest you and talk to someone there about it. The Veterans Administration is another source.

Basically, she had to have been married to him for ten years while he was on active duty. I don't know if she would even be eligible for him to pay part of his retirement so that she would get a portion for life. When I retired that had to be done at the time of retirement.

I will wish you the best but I seriously doubt there is anything waiting for your mother. Sorry.

Til death do us part, what words ,and really how many people stick with it til the end...I'm sorry to hear that your mother wasn't well and her better half couldn't cope and lost a husband while going through it also, but if they are married when he pasted away then she has everything,and all the rights which she is in titled too..she is still his wife oh and pension also..she needs to have everything closed down til she can sort this out, meaning that no other family member from either side should be-able to take anything out of home,bank,car,I mean anything til she deals with it, it is all hers til a judge decides other wise. if he had a girl friend staying, kick her out, she isn't in title to anything until she makes a claim and the judge will decide that also....your mother holds all rights and i would get on this fast.

My mother-in-law's husband walked out on her many, many years ago. He died two years ago and no one knew they where still married. He had been sick and his sister took care of him, but when she decided to take possesion of everything he had, she couldn't it all belonged to my mother-in-law (all his property, savings, retirements and life insurance money). Her husband was in the military as well and now she gets a check plus medical insurance through them.

Get a lawyer she is entitled to a lot!

Get a lawyer , she should be entitled to somethings. Depends on whether he had a will. Who's name was the house in. Who buried the guy? Who paid for his funeral? Your mother being his wife may be responsible for his bills.
Get a lawyer. This is a two way street, she maybe enttiled to things, but also responsible for his bills. Get a good lawyer.

Of course she was his wife! You better check on things right away for her or his family will take everything! Or they could stick her with his bills! Get an attorney ASAP! Good Luck!

Were they still married the day he died? He may not have provided for her in his will. Contact someone from his branch of the military immediately.

If still married at the time of his death, she is absolutely entitled to a portion of his estate...even if there is no Will.

If they are still married she is entitled to a lot!!! Get a lawyer to help you get everything in line.
