I lived in an apartment with some friends a while back. Due to a family health crisis, i had to move out. I gave my roommates about 3 weeks notice, even offered to find a replacement, but declined. At the same time, my roommates boyfriend was staying with us from out of the country. He didn't work and didn't pay rent. I suggested he pay, but my roommate told me it was impossible b/c he didn't work. I left it at that. I gave them notice and they rejected my offer for a replacement. I had bigger family issues to deal with.
Now, the lease is completely up. The roommates are moving out and going to live elsewhere, seperately. When we moved in we each paid a $700 security deposit. We each wrote checks for this from our own accounts, using our own checks and sent them to the landlord.
I made the landlord aware I was leaving and someone else was living there and not paying rent. The boy had been with living with us for 3 months at that point and not contributing.

Am I entittled to my security desposit back? I know techinally they can take it for back rent. But, can't I claim the same for the free loading boyfriend?

my roommate also claimed he could not be put on the lease b/c he was on a visa. But that doesn't mean you can live someplace for free, right?
