Hi I(we) have started a one consultancy Business after taking Franchise form well known Consultancy (Hyd based) at Bangalore. But The Consultancy CEO cheated us by giving dummy requirements ( his plan was to use us for his CV data base creation) and we worked on those requirements with 6 Employees for 8 Months and we lost 10L. The reason that he gave us was "our management failure"...then we told him to run our consultancy with his Team for 5 Months with target of 16L (Actually he gave us a target of 96L for 1 Year)... after running 5 months he was not able to generate 1L also. Now he is saying that he is not sharing our loses . What action i can take ?

Unless I see your complete contract between you two, I won't be able to tell you their liabilities with regards to this contract. On what terms & conditions the contract was made & what were the liabilities of each party with regard to it. As far sharing profit & losses equally is concerned its a general principle between the parties but there are certain conditions that are agreed by them while making the contract, what are all those conditions, if you lost 10L but the other party is not ready to share the said losses with you then if the terms & condition of the agreement does not qualify any terms & conditions with regards to sharing of losses is concerned, will such amounts to breach of contract or not has to be seen in totality. If it amounts to breach of contract you can claim compensation for it.

I by no potential personlly cheated in college yet others had and they were given an automated F on the paper and suspended for 3 days. a wide value to pay for dishonest dont ya imagine? And in college they can and could kick u out for some thing of the three hundred and sixty 5 days!
