I used to live a apartment with one roommate. I didn't like his behavior, so I moved out to the other apartment. I found a person who would take my place.
There had paid rent fee right on time. However, a landlord of the previous apartment, he called me today, they haven't received a rent fee. There was a late fee. One who subleted my place , he actually paid rent fee. But the guy who I used to live. He didn't paid the rent fee, and he told me, "I haven't paid specially to piss you off. I figure you annoy me enought to warrant it." If he does not pay the rent fee, do I have to sue him? Also, there is one more question.When I was fighting him about 5 months ago. He told me, "You can't speak English, Go back your contry." I pushed him into a wall. He didn't get injured, so didn't report. However, when I said him, "If you don't pay the rent fee, I will sue you." He told me, "You know that you physically assaulted me a couple months ago." will I charged in battery or felony?

You never HAVE TO sue anyone. However, if you are asking if that would be the proper recourse, then yes, probably.

Did you tell the old landlord that you were moving out? If not, you are still financially liable for that apartment.

Was there any witness to the alleged physical assault? Was there property damage? Otherwise, whether or not you pushed him, pressing charges for assault at this late date would be difficult in criminal court.

1. Sue him for the rent.

2. Was there a witness to the alleged assault? If not, then there isn't a thing he can do about it. You can deny it, saying he only is saying that to try to not get sued, and it will be his burden to prove it. Even if there was, odds are you'd get little but a slap of the wrist if you didn't injure him, especially considering the lawsuit. The cops and courts have enough to do without frivolous charges that waste their time.

All that said, you should be having this conversation with an attorney. This is a lousy place to get information on something this important. Good luck!

can he prove pain and suffering? was their physical bruising that he photographed? talk to a lawyer, but i doubt he has a case against you for battery.

as for the back rent, if you're both on the lease, talk to the landlord and let the landlord know what's going on. If he's nice about it, he may let you slide since you brought a good tenant, and only go after your old roomy. If he doesn't let you slide, you can pay the back rent, drop your name from the lease, and sue your old roommate. Or you could not pay the rent, which will likely hurt your credit, and wait until it goes to court to have your name cleared.

If you don't admit to the fight with him, it's your word against his. I don't think the police can do anything after the fact. You ought to sue this guy, he sounds like a real great person, a real stand up kinda guy.
