There is no signed lease, she did pay utilities until i decided that she need to go. However she takes full care of her two children and buys anything that the house may need like food and things for the children.

Where do i stand. We live in Florida

In CA you could not evict her, married or not, as this is her established home and you her established partner.

You should see a lawyer, you are likely going to need a court order with child custody figured out first. I doubt you could force her to leave without all of her children in any case.

Legally: If she has nothing in writing giving her the right to stay there, all you have to do is simply write up a letter giving her 30 days to vacate. Make copies, and give her one. Make sure the letter is dated. If she fails to leave, call the police. Make sure she realizes you will do this, though, and she'll leave before it comes to that!

What might be a better idea, for the sake of family harmony, is to just start charging her rent, unless you planned on getting rid of the house. If that were the case, then you can use that as your reasoning to get her to vacate. If you choose to have her pay rent, however, you can simply state that it is for the upkeep of the house. If something happens, YOU are the one that will be stuck paying for it. May as well collect and put way rent, just in case. Good luck!

No lease...no leg to stand on most likely...I know that in my state of NC..you would be considered living month-to-month when not bound by a lease and can be asked to move at any time and the landlord would be in his/her rights to ask you to do so...
I'm assuming (esp. by your avatar) that YOU are the one being asked to leave...paying utilities and buying food are just the necessities of taking care of children..and should not come in to play when deciding whether or not you should live somewhere...that way of thinking is just wrong..not to hurt your feelings....you do have to shoulder SOME responsibilities as the mother or guardian...

congratulations for looking after your child.

you may not like the mother or what she is doing, but she is looking after your child.

you didn't "wrap it"....so taking responsibility for what you did..congratulations............be thankful you have a beautiful child and not a "std"

otherwise pay a lawyer and be a jerk.. and be certain your child knows.....that you could afford to look after this child and treated the mother..that wipes that childs face and hands..feeds, clothes, etc., was kicked out because you personally didn't like her..

month to month means giving 30 day notices, side not once you kick her out be ready to pay child support if you are not now currently paying
