It depends what the photo was. If it was taken in a public area or place, then it is in the public domain, which means you can't really do anything about it. If it is of a portrait of a specific person, then the person who copied it must have written consent to have turned it into a painting, as the painting can be sold and profit without the consent of the sitter is illegal.

If the painting is similiar or inspired by, but not an exact copy of your photo there is nothing you can do. If it is obvious that the painting mirrors your photo i'd talk to the artist, and if that get's you no piece of mind, there's always small claims court.

Unless this person is selling the painting and making money off of it I don't think there is anything you can do but if he is making money off of it I think you are in your legal right to take action, it does not matter if you did not copyright it.
If this painter has made the painting very different from your photo then there is nothing you can do but it must be noticably different.

You can take court action on may things but in this case, don't bet the farm. Your might be better ahead to sue because of the photograph. Only an attorney can properly guide you so ignore most of the answers to your question. The authors are giving advice without expertise.

unfourtunaltly it's not against the law ever.
people go to art gallories and paint copies of the art all the time...
because the thing is, every painting is original.
and it is a different medium than a photograph...
so I'm sorry if this painter offended you... but she/he was just practicing the right to paint anything she wants to... unless it's copierighted

Go to the court and file your complaint for having copied the photo taken by you, b ecause it is against your will and it was taken without your consent.

None. You have copyrights on your original photograph only, their painting they have their own copyrights on their art, there is nothing you can do about that. (my solution would be: consider yourself "flattered", it was such a good photograph someone decided to paint it -- you were an inspiration to them!)
