I think you should wait until you have your citizenship that way she will be an immediate relative. If you file the I-130 now, it may raise suspicions. You can file the I-130 the day you get your citizenship and you can also file the I-485, application for permanent residence along with that and the work and travel permit. You can marry now, just don't file the paperwork until you are a US citizen. She can't get SSN until she receives the EAD card (employment authorization) Citizenship doesn't come until after she's a permanent resident for 3 years, you are married 3 years and you are a US citizen. I think you need to be a citizen for 3 years as well. She should not travel outside the US until you file her applications and gets the travel permit. good luck

You can marry your boyfriend. Illegal aliens are no longer allowed to adjust status in the US. This means that they must return to their home country for their immigrant visa interview. You should be aware that illegal presence in the US for over 1 year carries a 10 year ban. There are waviers for this but it is discretionary, so if they don't want to give it to you they don't have to. You should consult with a reputable immigration attorney and then weigh the pros and cons. In Miami, I hear an attorney named Andres Alonso is good. You can also try Catholic Charities.

You can marry, but it will not change her status. You will need to get her out of US without triggering a deportation proceeding. I have heard that there is no penalty for some illegals who leave voluntarily. Before doing anything though that will bring her to the attention of USCIS talk to a lawyer specializing in immigration law.
As an LPR you can file I-130 to bring your wife to US as a Legal Resident. So if you can get her back to her home country you will be able to file I-130 petition for immediate relative. Her visa category will be F2. Once you naturalize her visa category will automatically upgrade to CR-1 and your petition will be processed without any further wait for a Visa Number.
For general info and forms, Check the Following:
The website of the US Embassy in her home country
The website of US State Department: http://travel.state.gov/
The website of USCIS: http://www.uscis.gov/portal/site/uscis
A good immigration Q&A forum. A decent generic one is http://www.visajourney.com
Good Luck & God Bless

You have to sign statements about yourself and it will show that she is an illegal and you could get into trouble for helping this to be hidden so go and make all the necessary steps to make everything right so you start off with no threats etc over your marriage ~~

The marriage can be done, and will be valid. It should not affect your path to citizenship, but I cannot assure you that it won't. Once you get yours, you can certainly help her get hers; ask for help from specialists in this area. Welcome aboard!

the best thing for you and her to do is to have her go back to her country, marry her in her country, then bring her in as your wife. DO NOT DO NOT attempt to legalize her status while here, it will not work. this is not legal advise, by the way, just to clear my ***..lol

get your citizenship first. of course you can marry whomever you want, they be communists in china or a tranny from timbuktu. but get your citizenship first, it'll be easier for her to process her papers.

You'll have to make her legal first.
Otherwise, its illegal to do so.
Enjoy your marriage!
