I have recently decided to purchase an 07 Xterra. I have yet to pay for the car. I have filled out a lot of papers such as a "you owe/We owe, a power of attorney concerning title transfer and some other ones. The car i chose is not at the lot. They promised me the car the following day, but three days later no car. They stated that they were having difficulty with another dealership and they had drop the ball. They even said that they were going to drive the car approx 300 miles to my location. I stated that would not be acceptable. There customer service has been quite lame. I had to call them to find out the status of my vehicle. I placed no money down and gave them no sort of retainer. They also wanted to run another credit check after I stated that I have a blank check from my bank. Can I ditch this loser dealership?

If you don't have the car in your posession, you don't own the car...the paperwork means nothing if you don't have the vehicle. When they have you sign all that stuff, they just want you to feel committed, but you're not comitted to a thing until you drive the car off the lot. Then, it is yours no matter what.

BTW, there is no such thing as a 3 day right of recision in car deals like that other guy said; just a myth. Once you take it home, it's yours, but not until you take it.

Call the dealer and talk only to the sales manager tell him of your reasons stated above why your not going thru with the deal. and get your paper work straightened out. I have never had to sign power of attorney to buy a car. Are you trading in something that has payments left on it and adding the balance to the new car loan? If so remember the extra payments are a financial agreement that is not covered by the insurance carrier unless you also buy GAP insurance too. Be very careful "SHARKS" are not only in the sea. It is almost always best to arrange to sell your old car yourself and clear the remaining payments before going to the dealer for another loan, or get the money in advance as a bonified letter of credit from your bank.

call the dealer during normal business hours and ask to speak with the general manager, not the sales manager. tell him you are cancelling the deal. if you have copies of what you signed call the bank or finance company and tell them the deal has been cancelled too, then follow up both with certified letters with return receipt requested to both the manager at the bank and the general manager of the dealer.

I would not only ditch them, but go back to the dealership and make sure that all of your signed paperwork (especially the power of attorney form) is destroyed.

well, all i can say is, if you're gonna ditch them, you'd better let them know, otherwise you will indeed end up with a car and a car payment and a very dissatisfactory experience that you will be bitter about for a long time.

check your paperwork, most deals have a 3 day cancelation policy. but considering the car is not even at the beginning stages of delivery you may have additional rights to cancel the deal, or because you do not have a long term checking account, they may cancel it for you.
