on a month to month contract? If it wasnt written or Oral then is there even a Statute of limitation ? i.e.. a land line in which you call in a order a home phone service I sopke to the Telephone company and they ststed it was a month to month contract nither oral or written.

Telephones generally fall under the UCC for utilities for a 4 year SOL.
Though you should check your states statutes to make sure it does not fall under open (if it is a month to month deal)

A general contract that has month to month terms would fall under open, but since this is a utility (and depending on your state statutes), it would probably fall under the UCC.

The SOL should begin on the date of your last payment

If you are still within SOL, they can legally sue.

If it was neither oral or written, it doesn't exist. Either you misunderstood the person you talked to, or they are clueless.

There is probably a statute of limitations, but it varies by state and by the type of contract.

As long as the company has proof it has provided a service to you for any particular month yes they can sue unless you have proof to show you specifically advised them on any particular month (i.e., February) you no longer wanted there service.
