My ex has title of "primary household" over our son even though we have joint custody...my ex has a history of domestic violence against me, which is why I divorced him , and now he has had an altercation with his stepfather, in which physical violence is involved. He was living with his mother and his stepfather with our son. My son is otherwise loved, but I fear for his mental health. My ex moved out and is living with his on-again-off-again girlfriend. His previous girlfriend was on-again-off-again as well, which he moved out of her house at least three times, with my son. This is an unstable environment for my son, and my ex has always been controlling, manipulative, etc, which is the ONLY reason he has primary household..I have tried several times to get primary custody, but the court systems suck nowadays, and they want CONCRETE PROOF that there is a BIG reason to change the way the custody arrangement is now. .Any lawyers in the house or anyone who has an opinion?

Of course the courts want concrete proof of a bad situation. Can you document the violence in the household - will his stepfather testify? Can you see bruises on the child? Can you prove that this man is moving all over the place?

Talk to your lawyer about this.

What you need to do is go find an attorney. When I went through the divorce with my ex husband, I got sole custody because their father had past history of suicidal tendencies and therefore was considered a threat. He does have supervised visitation, but is not allowed to be alone with the kids. Go consult with an attorney and have some kind of proof of the violence. It helps. Good luck!

Your son is in danger and needs to be removed from his father's custody. The victims need to call the police whenever there is violence so that you can build a record against him. I recommend that you contact your local provider for services under the Victim's of Crime Act (VOCA) in your area. Try the area mental health center. You can also do an internet search for domestic violence support in your area. Services under VOCA are free and they have expertise in helping women and children in your exact situation.

if your son is aware of this then he is learning from his father that violence is okay. But is there an important reason why his father has primary household with your son? talk to a family lawyer and a domestic violence counselor.

Proof is right
many custody cases accusations are made on claims such as these
if you say hes violent and it is proven that it was really Slander on Your part then youve opened a whole new can of worms

How old is your son. You can only go back to court and try to get physical custody.
