The process varies greatly from state to state, so it's hard to give you an accurate answer- Some things I know you'll need are your birth certificates, proof of divorce if either of you has been married before, or death certificate if one of you was widowed, and your daughter's birth certificate (not actually required, but will help convince the Chaplain that you're sincere and not being impulsive).

You should go through his assigned counselor to get it arranged. The counselor will get all the paperwork together and push all the right buttons. You will just need to fill out a form that says you know what his charge/crime is, how long he will be sentenced for, and if you were or were not married before..have any children with or without him as a father..then you get the marriage license by yourself and the ceremony will probably be in the visiting room or chaplin, depending on his security risk..you also need two witnesses that are already on his approved visiting list...or if they're not already on his visiting list, they needed to be approved and added on.
By the way, as far as I'm concerned, the Warden doesn't usually get involved with inmate weddings (in regards to setting it up), so don't waste your time bugging him about it.

The prison has a social worker who handles the details of how it takes place. Each Facility has different rules so that's why it is an internal thing.

Call the jail and see what they say. I've never heard of them allowing this unless maybe they were on death row or some really extreme sentence, but call anyway. Really I think you should wait until he gets out. I mean you've waited this far and it sounds like he may be in there for a while. Plus, it would be wise to talk about whatever he is accused of prior to marriage to see if you really want to go through with it. Please don't marry him just because you've been together for four years and have a child. Think about YOU too.

who would marry someone in prison ? that is an awfull place to get married omg . are you sure you want to do this ? call the prison and find out I am sure that they will be glad to help you with any info you might need . good luck .

Yes, I agree - call the prison, they will tell you what steps to take. I think its a dumb idea...I would wait until he's out that way you can have a proper wedding and honeymoon, not one tainted with a prison memory. Why not wait?

You need to contact the prison chaplain first and make sure it is allowed. If so he will be able to perform the ceremony and help you get the license as normally both you and your fiance have to be present to apply for it. He should be able to tell you what the prison will and wont allow. Congrats.

I hate to bust your bubble, but when men are in prison they say and do alot of things they don't mean. It's called prison talk because they are vulnerable while they are in prison. If he wasn't in prison would he still want to marry you? Hhhmmmm.
