My daughter's father wasnt there when I our child was born..now he's around and we are gonna get married..What are the steps I have to take to change her last name and Do i have to wait until we are married?

You can go to Probate Court and file papers for a change of name. Her father will have to probably sign off on the papers also. It don't cost much, it's cheaper doing it yourself rather than hiring an attorney. You don't have to wait until you are married.

After you get married (at least in the state of Texas), you can file an amendment to the birth certificate and present a copy of the marriage license. It is much cheaper than petitioning the court.

I'd just call your local bureau of vital statistics and as them first.

is he on the birth certificate? I would ask the courts or the social security office
