Your should talk to your lawyer about this but I would guess this person would not sue as it would expose him to public notice and make you a hero. Is there no other reason you could fire him? I bet the other employees might know something.
I think he could sue for unlawful termination. You should have all the employees fill out a new application, you did not agree to employee all of them when you made this purchase did you?

A person can be fired for any reason unless they have an employment contract (pretty much, Sports figures are the only people with those.)
Or - if this is a Union situation - you need to abide by that contract.
Otherwise - the person is probably "at-will" (check your employee handbook if you have one) and if it says so - you can fire them "with or without cause, with or without notice" in almost ALL states.
I would *advise* that if you do terminate them, NOT to give them a reason - you are not bound to do so. And, giving them one may only make it more difficult later. You don't want to give them the groundwork for trying to sue. Just let them know the needs of the business have changed.

Was this something that was hidden from you? Did the employee lie to keep you from discovering this during the hiring process? I know a lot of job applications ask about prior convictions. If a person does not list a conviction, then that person can be fired for lying on the application.

Yes, and you don't have to tell them why their employment is being terminated unless you are in CA or ME. Those states require just cause, and leaving off something like child molestation is pretty serious.

well, i think its ......oh, i just read your answer now. and thats just made ,me feel a little angry finding out about their criminal background. but to be honest i dont think you can do that unless its affecting their working behaviour. but if you knew this before, i think you could have chosen not to hire this person. but unless their criminal background has been brought into to the working environment, and is causing problems you could fire him- i.e if he was a teacher. (personally it does make me sick that some perverse adults can do what they do), i hope you make the right decision

If he works with children then yes. If he lied on his application then yes. You are at liberty to fire anyone as long as you have solid ground for doing so.

yes, bc they didnt disclose this information, they signed a contract stating that their backround was truthful, u have a right to terminate someone based on their criminal backround if it turns out that they lied or tried to hide it. te right thing wouldve been for them to have been upfront about it. good luck!
