They have will's my friend they just don't choose to speak about them as do most people don't choose to discuse their will's And with driver's it's bad MOJO to speak of those thing at he track and thats where we as fans get most of our exposer to the driver's. Hope this helps! Have a great day.

Drivers do have wills.
Dale Sr had a will.
Dale Sr also knew that Dale Jr was not ready to run DEI at that time. When Dale Jr matured, the will would have been updated.
Dale Sr also believed that Theresa would take care of things thr right way.
When tragic events happen people respond differently.
It is quite possible that Theresa is no longer able to run the company as it should be, but rather runs it so she has something that she and Dale Sr built together - something to hang onto.
I am not saying that her actions at DEI are right or wrong - I am just saying there could be emotional reasosns for hernot wanting to give up control.

Hi,
most racing drivers, as most other people DO write wills. As I understand it Dale Earnhardt DID write a will and he left his stuff to who HE wanted it to go to. Do you think he should have asked you first where he could leave it?
Have you enough time to take over this legacy responsibility for ALL drivers, or are you only concerned with American drivers?
Anyone is allowed to leave his money, his company or any other item to whosoever he wishes...what gives us the right to challenge that?
Would you mind if I advised you to leave all yours to me?
It's Dale's business, not ours.

He did have a will, but the company is a separate thing. Most business-owners don't own their companies outright, they share ownership with other people, and that relationship survives the death of one of the partners. The remaining partners usually decide what happens to the dead partner's portion of the company, unless there was an agreement in place which covered the possibility of death. Many business owners make the mistake of not planning for their own death. They buy life insurance and think that's enough, but a lot more planning is required to prevent things like the loss of a family company to the other partners.

See that's the problem with all the Earnhardt sheep blabbing about hwo Dale would have wanted Jr to have it or Dale would have done this or Dale would want that. BS, Dale wanted Teresa to have THEIR company, that's why he gave it to her in his will. End of story.
