The driver is the responsible party to keep the child and all passengers safe. In some states, such as the one I live in, it is legal to remove a baby for the purposes of breastfeeding. In all cases, children do not understand the danger of being unrestrained and rely on the adults, or driver, to teach them.
In an accident, they will be the victim.

I feel that both the driver and the mother should the driver should get the blame as this is to ensure the innocent child is always protected and is the priority in safety and the responsible agencies(like cops) should make it known to all from the very beginning at the driving school.

The driver is responsible for the safe operation of their vehicle. My children (and now my grand children) know the car will not move until they have their belts on.
If the case you have outlined, mother in the back seat and the driver hasn't yet noticed and gets pulled over...yes, the driver could get the ticket, and I would hope the mother would pay the driver back the costs of the ticket.
If you are using your mirrors, it wouldn't be long before you'd notice the baby was out of the seat though.

The driver is the one responsible for everything in the car. This includes all required safety procedures and equipment. I know it doesn't sound fair to you, but the rules are the rules. Sorry to hear about it, but if you would have had a wreck, the poor baby could have been killed, or at least injured. good luck.
If you think it will do any good, go to court and fight the ticket. I doubt if it will do any good, but you may get traffic school out of it and at least save some money on insurance.

I personally think the mom should have gotten the ticket. Because she should have told the driver that her child needed to be fed and that she wanted to feed the child. I know that the driver bears a lot of responsibility. When I give someone I ride I let them know the "rules in my car", which is for adults and children alike or else I don't drive them anywhere.

You talk too much. The answer is yes. No argument, no gray areas, no excuses. To be fair, the driver gets the ticket and then beats the crap out of the "mother" who took the baby out of the restraint until she pays the ticket. I am so so so sick of people who try to figure out creative excuses and blame other people.

breaking the law is breaking the law doesnt matter I think the only time allowable is if it was an emergency run to the hospitol, but even then it only take seconds to get into an accident and the backseat is the worst place to be unrestrianed
