Let say i hired an escort, and I have their number and they have mine. Let say once meeting the escort i pepper spray the escort, knock the escort out, and then take their money could they file charges, even though they are offering sex for money which is illegal everywhere. Lets say my phone is pre-paid could the escort track me down, although prepaid is untraceable? Let me know your thoughts.

Yes, she could file charges. Assault and robbery are totally independent of the escort business. Prepaid is not entirely untraceable, you just need a subpoena from a court.

First of all 2 wrongs don't make a right. Number 2 has money changed hands for the deed. If not they have done nothing wrong YET. Number 3 Aggravated Robbery (the crime you just described) is punishable by 25 years to life in the State Of Texas...As far as tracking you down your phone is least of your worries. Street people have long memories for stuff like that and they will find you. Also they might file charges on you for hiring the escort in the first place and they probably say you hired escort just to assault and rob them which guarantees a stiffer sentence.

LOL! I think the sheer fact that you've bothered to ask this question is funny!!

Ever watched an episode of cops? This is like something that happens on that show from time to time.

Assault is assault, and pepper spraying someone who's not attacking you is assault.

The escort might not report you because questions would probably arise about what happened... but I'm sure the escort could lie and say whatever they wanted... the man concern would probably be that you assaulted and robbed someone.

Maybe you both would go to jail.

I don't really care. Hookers are hookers and people who assault people and rob them are bastards. Both of you could be locked up and I'd be sitting at home watching you all on cops laughing my @ss off!

Thems just my thoughts on the matter...

btw Prostitution is not illegal everywhere. Try Nevada.

An escort can file charges against you no matter what his/her crime is. There have been several cases where a prostitute got bashed and/or robbed and the assailant got busted for it. No matter what the original crime, you rob a prostitute and you've committed that crime. You can be charged with assault and battery and theft, and then charged also with soliciting a prostitute, that will all come with jail time, a prison sentence afterwhich you'll have a record. The prostitute will be charged also with soliciting sex for pay, but that's all. he/she will get off with a fine probably if not a minor jail sentence. But he/she can also sue you for mental and physical damages and cost, and if you were convicted for it that's all the proff he/she needs to win judgement against you. You better pray that calling card is all the prostitute got on you. Cuz you're BUSTED!

With all sensibility in mind, you should be less worried about the legal ramifications, and more worried about the pimp that is more than willing to put a bullet in your head and/or break your legs for messing with his business. Escorts never show up alone and always have some type of "safety procedure" set up in case they run into trouble. As for the legal part, most states view prostitution as a misdemeanor "victimless crime" with a fine / small jail time. The robbery that you intend to commit is considered a violent felony that will put you in prison because of your calculated efforts to lure and injure a victim for his/her money. A DA will work out a plea bargain deal with the victim in exchange for their testimony against you to gain a felony conviction.

The old adage two wrongs don't make a right applies in this case. Simply because she was committing a crime does not some how absolve you of your criminal act. From your "hypothetical" you could be charged with assault with a dangerous/deadly weapon (depending on the jurisdiction), robbery, and solicitation of prostitution.

In regards to your prepaid phone, it depends on what information your telephone company has about you. What information did you supply them when you signed up for this phone? Credit card number, address, phone number, e-mail address? The law enforcement agency could obtain a subpoena for the phone records to obtain your contact information. In addition, even if there is no way they could obtain contact information from your prepaid phone, it is possible they could obtain a list of the numbers you have called or who have called you and attempt to track you down that way. Remember you have the right to remain silent, invoke it if trouble comes.

I would imagine escorts are not entirely that unprepared.
Would you rather deal with the cops, or Guido.
It might take a couple of days for Guido to find you, but I suspect he will.

Yes they could file charges. Regardless of profession, people have civil rights. This is the case brought up all the time by drug dealers who claim cops are violating their civil rights. Yes, its BS, but they still have Life, Liberty, and the Pursuit of happiness as guarenteed in the constitution.
P.S. they can trace it with a warrant

You would be looking at robbery with violence - and yes, pre - paid is traceable buddy.

If the escort and you 'did the deed' - and you didn't pay her the money - she couldn't report that to the Police as the money would have been gained by illegal means (ie - drug money, or in this case - money for sex).
