I was involved in a 3 car pileup on the freeway. I was in the middle. The person who hit me has no insurance. The damage to my car was $1300. The damage to the car in front was $1400.

Now, the person who I hit (the car in front) says shes going to report it to my insurance, but since it wasn't my fault, what will my insurance company most likely do? I have all of the information from the guy behind who caused the accident, but since he is uninsured, will my insurance have to pay for the car in front? Thanks for any advice.

Myself and the car in front were at a complete stop, i even seen him coming in my rear view....I tried moving to the right (onto the shoulder) to avoid him hitting me from me behind but didn't quite make it.


I reside in CA, with liability insurance.

The girl in front of you can report to your insurance all she wants.... they dont owe her a thing. Let her go whine to them and they will take care of her.

As far as your damages.. if you dont have collision on your policy the only thing you can do is take the driver to small claims court.

First, you must get a copy of the police report. Since the damage was caused by the car hitting you, they are at fault. Don't be intimidated by the other driver. Many people threaten to "report" the driver to their insurance in the hope that you will try to settle to keep your insurance company out of the loop. You have insurance, and they are going to act based upon the police report.

Second, contact the state to find out if you have recourse against the at fault driver. In many states you can sue, but if the person has no money, you will never be able to collect.

Third, contact your insurance company. You probably have coverage and they will repair your vehicle if the police report states that you was not at fault.

People keep asking why some stop leaving so much space between themselves and the car in front. This is why. You were hit, the fault of the person who hit you, you hit the car in front because you were stopped too close. Your insurance will likely pay for the car you hit. Your car will likely not be covered unless you can collect from the uninsured driver who hit you. Much may depend on the speed of the car that hit you as well, and what that driver was charged with. Good luck.
By the way, this is one more illustration that liability only insurance IS NOT INSURANCE ON YOUR CAR, only on damage you cause to other persons and their property.

You have to turn this over to your insurance company. If they decide your at fault for the guy in front of you, which is possible, then they will pay his property damage claim. The guy who hit you from behind has no insurance, then yes you can take him to small claims court. Don't forget to fill out the DMV form SR1. It's the law. It also gets the DMV to send him a letter asking for his insurance info. So it gets him in more trouble if he does not have insurance.

Please contact your Insurance Co. I do believe that most States have the Under /Uninsured Provision. Give all the Info to your Ins. Co, including the Police Report. your Co. should advise you not to answer any Questions the Other Persons Insurance Co might ask you and refer them to your Ins. Co.Good Luck.

Who got the ticket? She can report it to your company, but if the other person is at fault, she may not be able to touch your company. Call your insurance agent. Take the other person to court.
