ok we got in to a reck from behind,after everything the tow truck guy told us to get our stuff becuase he was going to tow the car. i told him my stuff was in the treunk, where the other car was connected to us from the impact. he said to wait untill he seperates the cars, he started to put my car up on his ramp about half way. the car the wrecked us was about 4 feet behind. he told me to get my stuff but i asked him for help, when he leaned on the car the chain came loose and pinned only me in between both cars, now my legs are damaged but didnt break, suffering severe swelling, numbness, bruses, and having hard time walking, sitting, sleeping. so what do you think i should do? i want to Sew the tow truck company but do you think i have a good case? if yes how much do you think i could get? any help please.

Sew them for what? You have to prove negligence...if you can prove it, go for it.

The tow truck driver was neglegent in allowing you to be in a position where you could be injured, and not making sure that the vehicle was secure. You should never allow anyone (other than a professional) near a vehicle while it is being loaded on a rollback!! Cables break, chains pop off, and people can get hurt!!

Contact the tow company, and if they and their insurance company are not willing to help you, a lawyer would be your next step.

that is absolutely the tow drivers fault... unless you left something out. they probably have something for just this in the insurance for the company, well some tow companies do.

i would just demand compensation, then threaten to sue, then sue BIG TIME. i would never tell anyone to step in the path of anything as heavy as a car while it is in a unsafe position... and even if its chained up, unless the platform is FLAT its not a safe place, as you found out. people like that may say they can learn to never let it happen again, but its not worth it, maybe next time its a little kid who can't recover.
