You can still file 2004 and 2005 and claim any refund due. There is NEVER a penalty for late filing at the Federal level if you are getting a refund.

Some states DO assess a penalty for late filing even when a refund is due to the taxpayer. OH is an excellent example -- they'll slap you with a $500 penalty for late filing and deduct it from your refund or send you a bill if the refund is less than the penalty.

It is too late to claim a Federal refund for 2003, the deadline for that was April 17, 2007. There is no way to get around that. (A few states do allow more time to claim a refund so check with your state tax authorities on that.)

You still need to file the 2003 return though as the tax year is still considered "open" and the IRS can therefore address any issues on it at ANY time. The statute of limitations clock doesn't start to run until you file a return so an open year is an unlimited invitation for IRS scrutiny even years from now.

The latest you can file for 2003 AND get a refund was this year April 17th, 2007. You will not get penalized for filing late IF AND ONLY IF you were going to get refund. If you file the return for 2003 and if you were entitled a refund, you will not able to get a refund. But you still have time to file for year of 2004 and 2005. 2004 and 2005, yes, if you have a refund coming, you'd get it and wouldn't be penalized. It's too late to claim a refund for tax year 2003.
