My boyfriend and his mother purchased a house together, but his mother is leaving everything to his sister when she dies. My boyfriend thinks he will get the house without any problems. I am trying to find out if the sister would inherit the mothers half of the house. The mother pays the house payment each month and my boyfriend pays his mother his half.

If his mother is primary lender on the house he could still have his name on the deed.If his mother passes the sister will get half the contents in the house and garage and half the value of the house.If your boy friend pay for all the appliances she will get half.He needs to keep all the receipt's for any repairs,upgrades and furnture so she she can't claim half

I think the REAL Qu is: Why on Earth would a man buy a house with his mother in the first place????!! What was he thinking?? Does he have no plans to be with you???? The mother sounds like a very 1) Needy Mom or 2) Sceaming sp? Mom!! She sounds like she has the upper hand and her son should get out from under and start living his own life!! Which leads me to think that that's what you need to do for yourself!! Find a man who wants to buy a house with YOU!! And start a life together!!! GOOD LUCK!

Uh oh...if his name is not on the deed then he might have some problems. Will his sister try and take the whole house if the name is not on the deed? If his mother is coherent, you might want to talk to her about this because it could get a bit sticky after she is gone.

Otherwise if his name is on the deed for the house, he should have no problem.

i'm assuming the house deed has both their names on it.

if there is the word AND between their names, the house might have to go through probate, and it's anyone's guess whether the sister would get 1/2 (you'd have to ask an attorney).

if the word OR appears between their names, when she dies, the house should automatically become your boyfriend's.

It depends on if his name is on the deed. If they have a survivor ship deed and both names are on it then yes, he will automatically get the house. If not...he should get it changed as he is paying for half now.
