I have to fill out an injured spouse form for the IRS, and have many many questions about it, the IRS wont give me any help with returning my calls, hopefully someone can help.

I was told that i would need my W2 s to fill out this form, well the tax office has kept them and will not give them to us, i have mine but not my spouses, and I am having a difficult time with this form, please help me,

I am already using the taxpayers advocate service to file for injured spouse, they are why im having such a problem filling out this form. No returned phone calls

The office that prepared your return should have given you copies of the W-2s with your copy of the return. If they e-filed your return, they need to retain a copy of each W-2 with your return. In my H & R Block office, these document are filed numerically by DCN number (Declaration Contol Number). It would be difficult to find and make copies of these documents once filed.

The form itself is fairly easy to complete. It has a few questions to answer and columns to list income, deductons and exemptions allocated to injured spouse, the other spouse and joint.

If you already filed your return, you can file the injured spouse form by itself.

The injured spouse has to have income, and withholding of their own to benefit from using this form.

The best way to file this form would be t allocate all dependent exemptions to the injured spouse. Any itemized deductions that are specifically for one or the other spouse need to go with that spouse (state tax withheld, employee business expense, etc), but other deductions can be split any way you want. (Give as much as you can to the injured spouse).

You must fill out Form 8379. This is the main reason you need your W-2. This form allows the IRS to see your income versus your spouses individually even though you file jointly. The injured spouse (the one who will NOT have the tax return money taken by the government) signs and dates this form. Attach the form to a complete 1040A along with other forms you may need as well as W-2s and other tax documents. Make copies for your records. Mail to the IRS.

If you already know your combined income, taxes paid, etc., you can subtract his amounts from the total to fill out the column where your income goes.

Threaten to SUE the tax office for holding your W-2s. If they have half a brain in the office, you will have them back in under 5 minutes. You can also request copies from the employer that issued them in the first place. If this deals with tax year 2005 or earlier, you should be able to request a transcript of the forms from the IRS using form 4506-T

I can't help with the actual form.
