If someone recieves a Field grade Article 15 with 45 days extra duty, is the punishment "45 consecutive days"? I am a little more than half way done, but I was put on quarters for 8 days due to surgery. Can the command add those days onto the punishment, or do they still count toward the 45? I'm being discharged under Chapter 9, and all I am waiting on is my ETS Physical 1 & 2 to complete the legal packet.

yes in my expereince if you get sick they just stop it at that day and then continue from the day that you stopped doing your extra duty. It 45 days of extra duty not 40 days of extra duty and 5 sick days. Come on now if you can get out of how ever many days you were sick than you are lucky. Let me know how that goes

N O, depends on the surgery and when your ETS
Physical is. In some cases, the 8 days could be counted as your 45 days. This depends upon your Commanding Officer!!

I would check with JAG but from my experiences with soldiers on extra duty they can not add those days. Once it is imposed it is the next 45 days period. If your unit went on a FTX for 30 days the third day in when you came back you would have served 33 of the 45 days already.

Think about it for a second, 45 days of extra duty: If you were on quarters you were not doing the extra duty. They can but will they act on it???????? Refer to the Manuals for Court Martial for the answer that I found.

If you are on quarters, chances are you also have a profile. In your situation, it will be at the discretion of your CSM what extra details you will be made to perform.
