Gee, that's a lot of questions. Let's see...

Actually, if you read the README or documentation, most of the files you find on Download.com says cannot be SOLD. You can burn a lot of them to a CD in special "collections" and put them in a nice case with a fee, but you're actually only charging for packaging and distribution, not for the programs themselves. Why? They are NOT YOURS to sell, as they don't belong to you. Just because they are free doesn't mean they don't belong to someone. Same goes with most "free" giveaways software, or even Open Source software.

Oh, so sorry. That's still pirating. Pirating stuff from a movie theater using a camera is bad, very bad. In fact, some theaters give nigh-vision goggles to employees so they can catch video cameras in use. Others are going to include invisible text (to human eye, but not to camera) that says "PIRATED COPY" in big letters making such copies useless.

Write some yourself, or buy someone's software and sell more copies. If you buy program for $1000, but sell 1000 copies at $10 each, you made $9000. See?

It is illegal to sell something you didn't create without the explicit permission of its creator. Check the licenses on software and movies.

The only software that you can sell without any hassle is that which you write yourself. For any other you'd have to become a licensed vendor which usually involves the payment of a license fee.
