I am upgrading from an older laptop to a shiny new desktop. My laptop came with copy of Windows XP, and I don't want to fork out hundreds for a new one. Will it work if I use the old CD to install XP on my new computer, and is this legal?

No it will not work, that is an EM disk, that windows CD will only work with the computer it came with. if you want windows xp on that computer, you must buy a CD from the store or get in contact with the manufacture of the computer and see if they have a windows xp version for the computer you bought.

Also if you use any windows cd that is already install on another computer, and put it onto a different computer, that would be illegal. Only on copy per computer.

I think so.....try looking on the back of the case that it comes in, some software lets you share with up to 3 computers (like the new windows vista student addition) if not, try looking on the windows web site.

Its illegal (according to MS's licencing which many think is stupid), but yes.
