The story of the harmful effects of second hand smoke is largely, but not entirely a lie. The scientific basis for it is extremely thin for smoke in public places and some have suggested that it has been concocted. Whether the critics are connected to the tobacco companies I don't know, but it appears that some of them may not be. So I would not like to use your story as a defence in a court where the evidence rater than emotionalism was the main factor.

Justice is about the punishment fitting the crime. Smoking is not a violent crime but shooting someone is. Smoking is also not hostile. Also, second hand smoke is not as life-threatening as you seem to think it is so you could settle down a bit.
