i was hit by drunk guy from behind this weekend he was arrested and takent to jail...my brother was rushed to the ER but tankfully nothing was wrong it was just cause he was really scared....my moms insurance wasnts me to sue the guy but iam not sure what for or why...they told me that the man has to learn a lesson cause he could of killed someone........any advice???

That's a nonsense. The whole idea of insurance is to not have to sue anybody to get your repair/medical bills paid. Who is going to pay for lawyers in case you sue? Who is going to pay court fees if you lose?
Talk to a lawyer right away, and think about switching your insurance company ASAP. It looks like a scam. I wouldn't want to stay one more day with them.

Thats odd.
I have been in similar wrecks. Generally, if you are hit by another driver (drunk or sober) who does not have any insurance and you turn it in on your insurance-your insurance company will pay the damages to fix your car and then its up to your insurance company to go after the other party and sue them to get their money (the insurance companies money) back. Is your moms insurance paying for the damages to your car? They might want you to sue them so they can get out of paying. I would speak to an attorney.
Although i do agree that people like that should be taught a lesson, and if it turns out they were a repeat drunk driver then yes i would sue them. If it was a one time thing, i might cut them a break.

1. Don't rush into anything.
2. you need to find out the cost of repairing your car and the medical costs for everyone involved.
3. I would talk to an attorney of your own.
Insurance companies don't usually rush to sue the other guy, and are usually out to keep their costs low, but be cautious.

Ive been in 3 accidents and never sued anybody or been sued. One of them was a drunk driver i ws in the car with and i got hurt but why bother, just as long as they fix the car, let the police look after him, dont worry they'l make him learn.

You could get him to pay medical and damages. Regardless he's going to have legal problems.

well just think, if he had killed ure brother would you have sued him?
