i have ms and i am trying to get disability after 90 days they are supposed to give you a yes or no . they told me they were putting me on a diary for 90 more days and then they will give me an answer is this something they do to everyone before they get approved or they making me wait an extra 90 days just to get denined? and if i do get approved will i get back pay?

Is it the State or your job that is doing this?
My husband filed for State disability years ago (1998) and he was turned down the first 2 times he filed, and we filed a 3rd time and went to a hearing. After 10 minutes the judge appologized to my husband for him having to waste his time and come to the hearing... and hubby got approved for disability.
Some States automatically turn EVERYONE down the first time, as a rule....period. Then some states turn you down again. Most people just give up after the first or second time. Those who are really serious will keep after it.
The diary may be a way to try and dissuade you from continuing to try for disability. Also, if this is the state doing this, look on line for some web pages for your state agencies and see what the policy or policies are. I would start with the Social Security Administration for your state.
If it is your job doing this, well.. find out who the long term disability carrier is, and see if there is someone to call or write to have them send you their policies.

I'd say it's a good thing. I've been trying to get disability for six months and been turned down flat each time I apply or appeal, so if they're willing to put you on a diary, I would say you're doing better than I am. It's possible you can be denied at the end of the 90 days, but think positive. And they pay you from the day of application, so yes, you may get back pay. Good luck.

i think you mean 'diet' not a diary. a diary is what you keep by writing your thoughts, etc., into it. anyway, you are best to ask someone who knows more than us schmoes. actually we know jack and could send you all in the wrong direction. the best person or persons to ask this would be a disability lawyer or go on the net & there should be a laywers' site to ask questions. yours wouldn't be private but if you keep it anonymous, you should be ok. back pay? that'd be nice but don't count on it, but again, what do i know? ask a pro! and good luck!

if it's your first time filing you will get denied everyone does the first time, i dont know why they put you on that but you should seek a good attorney to handle who specializes in disability cases.
