As long as the owner pays to have the number every year. It remains with the owner year after year.

Nascar 'owns 'the rights to all car numbers. Teams must 'lease' numbers on a year to year basis. As far as the '#3' number goes RCR has kept leasing the number on a yearly basis. But the question is 'how many car #'s can a team have when they are limited to having only 4 teams and how would this affect RCR if they went to a 4 car team?'
I really don't see anyone using the "#3" in the foreseeable future or at least not til the end of Jr's career.

As long as the official owner of the number (i.e. Richard with the 3), keeps buying the rights to the number, yearly, then the number can remain as inactive as the 3 has been and more, until the owner wraps it up and calls it a day.

NASCAR dont own the #s the car owners buy the numbers, and as long as they pay for the number they have say of if its on a car or not

Nascar owns all the car numbers and unless they release the # 3, no one will be able to use it, even little E. And this is not a guess.

Babygirl hit the nail on the head. In past years, a driver leaving a team lost their number when they moved on. In very rare cases, a team has been known to sell the rights to another team so the driver could retain the number. One situation I remember was in 1980, DW left DiGard racing for Junior Johnson's team recently vacated by Cale Yarborough. Darrell wanted to retain the #88, but DiGard wouldn't sell it. When they were bought out years later by Robert Yates, the number 88 went with that team.

From what I understand the numbers of drivers in a fatal accident, or retired from the sport are permanently shelved.
