My friend is in another country, but it is hard for him to get a visa. I want thim to come over here- do i have to marry him for him to be allowed in the US? Or can I just write him a invitation letter? What do I have to do?

If you petition for him as a K-1 you have 90 days to get married. If you don't get married w/in 90 days then he is removable.

If you marry him and petition for him to come here as the spouse of a US Citizen then be prepared to prove that you married for love and not immigration reasons. Marrying just to get him an immigrant visa is both an administrative violation and a criminal violation. If the examiner is not convinced then you could face criminal charges and your buddy would then be removable (deportable).

You can either petition him as K-1 fiance (Form I -129F), or you can marry him and petition him as an Alien Relative (Form I-130).
