I am taking medication an infection and something didn't seem right. I had been taking medication for about 3 days and the instructions say:: use 2 teaspoonfuls, swish and swirl four times a day for 2 weeks. But the problem is, the bottle is almost empty so we didn't think it would last 2 weeks, and there is no refills. So we called the doctor, and it turns out that the pharmacy gave us the wrong dosage per day. Could I sue? How much could I sue for? And under what circumstances?

Swish & swirl? Was this a medication you rinse your mouth with then spit out? If it's something you spit out anyway, there's little chance of actually overdosing. It could be that your doctor wrote the prescription wrong, too. Unless you are able to actually see what is written, it could be that your doc wrote it wrong. Could be that the pharmacy made a mistake, too.

If you want to sue anyone, you have to get your hands on the original prescription and determine exactly what your doctor wrote. Are you really sure it was the pharmacy? Are you 100% sure your doctor wrote for the proper size of bottle, or the proper amount to swish?

I would be very curious to know what your ailment is, and what medication you were prescribed. I would research what the manufacturer indicates as the proper course of therapy before I trust that doctor or the pharmacist. Doctors and pharmacists are people, and people make mistakes.

If you want to sue, first you are going to need the original prescription and good luck getting your hands on that. How much could you sue for? Come on. Did it cause you any real damage? Are you somehow harmed or were you just inconvenienced? Mistakes happen, and it's not like you have suffered loss of life or limb, so I say forget it. It sounds like you used too much prescription mouthwash, and that is not really harmful.

You also have to be your own health care advocate. You shouldn't blindly accept anything from anyone, not just medication. You need to get in the habit of doing research on your own.

for sure you may sue! this is the excellent thing about united statesa.. everyone can sue everyone else for something at any time. even if you win is yet another question. in case you may not prepare negligence, you receives no advantages. were you medically harmed accordingly of the mistakes? If no longer, you gained't have a lot success. you may, although, contact the pharmacist and convey your difficulty over the remember. You by no ability recognize, perchance he couldn't study the overall practitioner's sloppy handwriting.

You can sue any time you want for anything.

However, you might have trouble winning your suit if you can't prove that harm was done to you. I'd suggest that you and your doctor call the pharmacy and get a refill with the proper instructions. (in other words, it wouldn't be worth your time; any half decent defense lawyer would have the case dismissed quickly)

Or, even better, switch pharmacies.

if you want to, you can sue your brother for farting too loud..

i hear the jury awards twice the damages if the farts smell particularly funky
