because if they were guilty then they wouldn't be a bystander. there are bystanders and innocent bystanders. bystanders are just observers, innocent bystanders are observers that get caught in the middle of what ever is going on, not by their choice.

To be guilty the would have to have been participating, therefore the wouldn't be a "bystander", some one who was just there.
