Sue if it actually merits it.
Don't sue because you were grossed out or because you think they have a faulty QC system. It's a chance discovery, you just won the bad lotto.
If you weren't physically effected (got sick) then I say don't waste our money on something that, and even if you were you'd have to blowing chunks.

Believe it or not, finding a bug in a pie is not a serious violation. If it is an excessive occurrence, then it becomes an issue. There are standards which allow for a certain percentage of things such as bugs in food. There's no lawsuit to be found here. Hostess will just blame the company that made the filling and the filling company will blame the apple company, etc.
Honestly, an anxiety attack?? It was just a bug!! It was extra protein!! Save the dramatics for when you really find something disturbing like a bolt, glass, or a rodent...something that the manufacturer actually has control over.

The best thing you can do is if you have the box that the Hostess apple pie came in or maybe some packaging there should be some serial numbers on it, call the company phone number and tell them what happened. And you will get everything resolved from there. As for trying to sue them it's not worth the time an money involved as this was a rare occurrence that you had this bad experience.

Have you ever done anything wrong had a bad day at work or just screwed something up ask yourself that and then decide if you should still sue!!! SHXX happens get over it ask for a refund or just put it behind you Sue happy people like you is what is wrong with AMERICA today! Can't believe you would ask this of something SO petty!!!!

I opened a Hershey's chocolate bar one time, and there was a live larvae of some kind in the chocolate. I didn't sue because it wasn't worth the time or effort or the $$$. I did, however, call the company, and I got quite a few coupons for free chocolate.

You can TRY, but you certainly can't PROVE it was there. If you decide to go forward, try to find a lawyer who doesn't get paid unless you do, or you could waste a lot of money for nothing.

Want to sue? Get a lawyer and put up a retainer and go to it! Might cost you $ 10,000.00. and he could start a class action. You might get $ 3.50 in about 10 years.
