Even if they each have one of the two children, if he earns a lot more than she does, there is not economical equality or opportunity between the two kids. IF this is what you mean, then she may have grounds for a claim.

Who is them?
Child support is based on parent income and used to ensure the child is taken care of. So, he might still be on the hook if he makes more money than she does. Also, depending on where you live, how often he sees the child could come into play.
Bottomline is really simple, nobody can you anyone play child support without a court order saying what the amount is. If your husband loves his children, he should want to do this.

Child Support is not owed unless so ordered by the court. Nobody here can answer your question. The answer is in the court order. No court order? No child support.
The court would consider the amount of income of each person. In theory, if both parties made an equal income, and each had one child, then a net zero balance would be owed on the support until the age of majority (i.e. 18 years old) of the eldest child. Upon that time, then support would be paid to the parent with the younger child.

Since there are two kids and you have split them up, where one stays with each. Then I would think there would be no child support. If there is no order for this arrangement, I am not sure how she is doing this unless she is saying she has them both. Contact the agency in person, and ask for someone to explain this.

You can go online and look up your states child support enforcement site and use their guidelines and forms to calculate support. If she ever received welfare (public assistance) they can go after him to repay the state for the money they gave her on behalf of the child. Your best bet is to contact any agency that sends you a letter and ask these questions.

well this is what will happen she will get her child support from him, but in turn he can get it all back from her.she has a child and so does he.until they go before a judge and let the judge cancel out child support he will have to pay and so will she.

It would depend. If your husband earns considerably more than his baby-mama, then he will have to pay child support, even if he has custody of one of the kids.
He had 2 kids with this woman and didn't marry her so how did you get him to do the deed? Just curious.

well she has one and he has one and if she does not pay support to him -he should not be required to pay, however if she is not working and he is he will still have to pay to support the other child because it still is his responsibility if she cant support the child-you can contact your local child support services office and they will answers any questions you have, but normally it is based on who has the larher income-good luck to you

You can take her to court and do the same as she is doing to you. She owes back child support as well as he does.
