I got a question when you are in mediation and its suppose to be only about visitation and the other party talks to you about everything else which you are not sure about but answer.

If the mediator says do u agree to the following and you say yes. Does that bind you ? We havent signed anything yet. But if mediator asks verbally is that still bind you in the court of law or do u need to sign papers first ? How about if i dont agree with one can I change that?

nothing binds you to anything until you sign a legal document. you can say i wish i could send you to the moon and have you never come back and have him agree and it doesnt mean squat!!! if you are unsure say i dont know.

Mediation is not a technique used by lawyers to find out what the other side is arguing. It is a relatively new concept, paritcularly with family law. It is actually better than going before a judge if the people involved can be positive about it. It lets the parties basically decide how things should work and helps them to learn how to resolve their problems without going to the court every single time there is a problem. Mediation is being used more and more to free judges for more serious problems. It's really not a bad thing. But no, if you don't agree, don't sign. Compromise.

First of all, you should NOT go to mediation without an attorney! It is clear to me from reading this that you have not hired an attorney. Yes, the mediator can bind you to it. As for whether you have to "sign" the answer just depends on how mediation is handled in your state. Frequently, you do NOT have to sign. If you object to ANYTHING in the mediation, do not hesitate to tell the mediator immediately. Also, do not answer any more questions! Hire an attorney.

Mediation is used by many attorneys to find out exactly what the other side is arguing before they get to court. This is why you need to quit answering anything you aren't certain about. You are only making things worse for yourself. Go hire an attorney.
