There is a very nice baby formula "Nutramigine" and it has worked wonders for our infany baby. However, its twice as costly as regular formulas and my insurance said that they will pay me fully if the Dr. prescribes it to my baby.
However the doctor doesnt want to, saying that my baby should be ok with any other formula as well.
Is there a way I can force the Dr to prescribe it to my baby? The other formulas are causing lot of colic/discomfort to our baby. Nutramigine suits are very fine.
I want to sue the Dr for not being understanding enough and causing us and our baby all this trouble.

tell him there is a family history of milk protein allergy in your families and you and your hubby have it...and your baby is vomiting up every other kind of formula you try to feed him/her...say he/she is up all night screaming and crying and has had horrible gas...then say you put him/her back on the nutrimigen and he/she is fine and happy.

Just buy the formula and deal with the price. This is your child you are talking about.

You can't make the doctor write out a perscription. Are you one of those people that insists the doctor write a script for an antibiotic when you have a cold? I'm guessing the doctor is probably right that you are just being picky.

You want to sue the doctor for not being understanding and causing trouble for you, sounds to me like you are a bit money hungry and look for every way possible to save, keep or get a buck including lawsuits and insurance fraud. Yup that's what I say you are trying to do. My doctor once told me that she had a patient ask for a perscription for Advil because it was too expensive. My doctor didn't and she never saw the patient again.

If the doctor doesn't believe that the expensive formula is better, you won't be able to force him to do anything against his conscience, and it's wrong of you to try. Trying to sue him for not doing what you want him to do, if it doesn't result in anything more than discomfort, will get you laughed out of the lawyer's office, let alone the courts. That's for wrongful death and/or long-term disability due to carelessness on the part of the doctor, not for something that's inconvenient for you (no matter how distressing colicky babies can be).

Even if another doctor agrees with you, that doesn't mean that the first doctor was wrong; he simply disagrees with you. If, however, you document cause and effect with the regular formulas (time baby was fed, how soon symptoms of colic appear, exactly what the symptoms are, etc.), you *may* be able to change his mind.

If you truly want what you believe is best for your baby, then money shouldn't be a consideration. It sounds to me like you're putting your pocketbook ahead of your baby.

While you can't sue the doctor for this and you can't force him, I would highly recommend looking for a new pediatrician. Do you really want to continue to see this doctor that doesn't take what you have to say seriously? Two of my three kids were on Nutramigen - one had a very serious milk protein allergy (was passing blood in his stools) - the other was just very fussy, sounded like your baby. My doctor had no problem either time writing a prescription for the formula, which was the only way my insurance would cover it as well. You need this prescription, because its outrageous how much more this formula costs. Good luck!!

You can't FORCE a doctor to do anything. (Suing them won't work either, you don't have a case at this stage, because you can't prove the doctor did anything wrong that would permanently damage your baby.)

Have you expressed completely how much your child benefits from the Nutramagin? If you've not CLEARLY told your child's doctor, in NO UNCERTAIN TERMS, that your child is doing night and day better on this formula, then you have no one to blame but yourself. Go back to this doctor and make your child's case.

If you have explained CLEARLY that this formula relieves your child's symptoms and he's much more comfortable and happier, then, as a parent, it's your right to seek a second opinion from another doctor, and I would do that as soon as possible.

You cannot "force" your Dr. to do anything. It's might be possible that he knows what is best. If you truly believe he does not then get a second opinion. There is no law stating you have to stick with a Dr. that you do not like, especially one who doesn't listen to your needs.

My pediatrician said not to give them milk when their chest is all congested because it creates more mucus. As long as she is drinking liquids of any kind thats good. See if you can get her to drink some pedialyte if she starts to act dehydrated. She may love it or hate it - some kids like it and others wont touch it.

Sue that sob was my first thought but in meantime buy the formula and try searching for another doctor who will prescribe the prescription. There is no way feasible I could see you forcing the doctor and I'm not sure why he/she isn't looking at matters from your perspective. I understand the doctor is an expert in field but parents who bring a suggestion to them should be given some consideration. Try writing to company who makes the formula and ask for coupons or free formula. I know it sounds like a long shot but it well worth it for sake of your baby. Good luck!

well, you really can't sue the doctor for refusing to write you a prescription for a particular brand of formula because it's not something you would otherwise be unable to obtain...and you really can't force him to write you a prescription either. Your doctor is probably worried that this is will be considered insurance fraud.

Your only option is to find a different doctor who is willing to knowingly bill your insurance for baby formula.

Well beofroe you do go to another Dr. and get as second opinion. Because a dr. shold always think of what's good for the infant. And if they give him something else or give you a prescription for it, I wouldn't worry. I woudn't recommend that Dr. to anyone else.
