what would you do if you were a single parent and the father of the child wouldn't even pay the child maintenance to help you? Is there a low on that earth which helps single mums!!!!!!!!!!!! because apparently I cannot do anything about him not paying the child maintenance as he claims that he is a full time student, and full time students are exempted from paying the child maintenance. He is 32 and I guess he will be studying forever......! Am really stuck and don't know what to do!

im a single parent too my son is 2 years old now his father leave me im 2 weeks pregnant at the time i dont know how to go on and so..by the time the best thing i did i went to my mom and talk about it and i ask her if i can stay with her until i can find job.. about the maintenance i ask my mom to help me for the mean time if he dont give you let it be he is not worth it to be the father of your child forget him and move on dont hesitate to ask help to your family...just be strong for everything dont lose hope coz theres the rainbow after the heavy rain..

Hello which country you live in? In India even if the husband takes a plea he is full time student the courts have held him liable to pay him maintenance, such a maintenance is fixed not on his actual income but his ability to earn & pay such maintenance, section 125 of the Criminal Procedure Code very clearly provides to this criteria while fixing the maintenance for the wife & the children. If you are not an Indian or covered under the Indian laws regarding maintenance then I'm really sorry for you, your country is really backward in this aspect of matrimonial enactment.

Where do you live? If its not USA and if you are in India.
Then it may be difficult. Going to court in India and suing
him may not work. You know even the Judges got to live
and make money in India. The Human smugglers go Scott
free where as for petty money as child support could go on
and on in court.
Try to talk to him, don't challenge him, show him that you
still love him and the child needs the father too.

In America the ladies have all the rights but still they
cannot hold on to their husbands and that's the reason
Asians are doing well and are more productive and
respects family values. In many cases there are five
fathers but only one mother, these siblings gets picked up
to spend the week-end with five different fathers.
While the wife is planning a night out with another guy.

Well!! if you can wait when he's done school and gets a good paying job, he won't have a choice but to pay back support for all the time he missed paying while he was in school. They will deduct the money from his wage, which will probably leave him the same amount of money as if he were in school. So you might want to suggest to him to pitch in now otherwise he'll be paying alot more when he's done school. There is no way he can get out of it,the child is his responsibility as well.

An Indian lawyer has already answered your question but such laws exist in all nations. Don't let him go scotfree. But you should think of taking up a suitable work to support yourself and your child. You should have mentioned the country you belong to. You need to be strong and don't give any importance to that spineless man. Your child is yours . If you are self dependent , your child will grow up respecting you.

Therer is no law that states being a student exempts

He will be imputed at minimum wage $900 a month and then they will order a percentage!
call your local da to get the number to child support office and get them working your case and force him to pay or go to jail!

He is choosing to go to school

he could work part time or something!
He is bullying you and don't let him

Law seems to be on the side of the father in the country where you live. I don't know if the judiciary there is open to a special appeal considering that the father is of working and earning age. "Look before you leap" is the most appropriate adage that comes to my mind after reading your experience. You should have looked before allowing that wretch to father your child. Maybe it is too late now to lament.

Assuming the father has been court ordered to pay you, he is bound by the law to do so regardless whether he is a student or not. You never mentioned what state you are in as that has everything to do with whom enforces what. Since he is currently in arrears, things are not looking very good for him when you get him back to court.

U have defined urself as a single parent but ur not understanding the implications that ur single and a parent. U must have realized the implications when seperating so dont crib about his share and get on with life tell him he is a parent too and try to get him to share his responsibilities but he seems to be a clever guy. wish u all the best in ur parenting

i don't get child support either and that is MY choice. i don't need his 30 dollars a month, i already can't pay my bills and that really won't help much. and he has never even seen his son so why do i want him to even look like he is doing the right thing by supporting him financially? what he needs is a father, and money is not going to give him that. and what he did to me is unforgivable. i really want nothing to do with him, and i am not kidding. even money. i want him completely out of my life.
