Are you talking State or Federal Disability, big difference.
State is relatively easy to get but only lasts for a year. Federal is extremely difficult to get and it's generally their policy to deny you even if you had terminal cancer. It's their game. If it's Federal he's trying to get, it could take years. If he gets a lawyer and wins his case, Social Security has to pay for his lawyer fees and they can't charge more than $4G, I think. He needs to have good evidence to prove his disabilities. If you want to email me, I can tell you more if you can provide more info.

Why a thumbs down? I know what I'm talking about, I had to play the game for a year and a half and had to do numerous things to get it. The info about the terminal cancer thing was told to me by the cancer institute where I live, a bunch of volunteers who specifically help people get SSDI and tour the country giving seminars, and they helped me get it.

He'll probably be turned down 2 or 3 times. This is routine for the SSA. Tell him to call Legal Aid right away--he's going to need them. A private lawyer will charge him an obscene amount to do the same thing Legal Aid will do.
If you or your brother can afford $4000 - $8000 to pay a private lawyer to help you, that's fine. The only thing he can do for you the Legal Aid can't is help your bro get benefits if he isn't qualified, which I doubt is the case. Legal Aid will help with the paperwork, arrange a doctor's appointment to verify the disability, and go to court with you. Exactly what the private guy will do. Only it's free. And it usually takes about a year, start to finish.
I've been through this twice and it went very smoothly both times.

Tell him to get a lawyer. It sometimes takes a year to get disability approved even with a lawyer. I can't imagine trying without one.

About 2 months until his second denial. Then he files for a court hearing. It took exactly one year to the month from the time I applied for a hearing until I was standing in front of the judge. I got a lawyer after my second denial.

GET A LAWYER NOW!!!!!!!!!!!!!!!!!!!!!!!!!!!

Social Security wants you to give up and go away quietly.

It will take a while to get a second response... If that is turned down as well, then you should consider getting a disability attorney... went through it myself, never got it... ever... better luck to your brother... :-)
