It's up to your supervisor.

You need to check your employee manual about the use of sick time. My initial response is no, you won't be allowed to use your sick days to cover time off like you are talking about. There may be other people with time off already scheduled and the company needs to have people to cover the work load. If you have already requested the time off and then call in sick during that time, most likely the employer could require that you bring in a doctor's note to cover the sick days you are thinking of using. And they would be entitled to ask you for that note as well. Then you will be forced to get a doctor's appointment to be seen by a doctor to get the note.

I have fired people for doing just what you are suggesting because they were told they could not take time off during a certain time period and then called in sick.

There is a reason they won't let you use your vacation days, probably your co workers are already scheduled to take time off and you asked to late. If you call in sick on those days, your co workers will be really upset and your boss will know you are lying.

If there is some other reason, check with your boss about how you can use your sick time, but my guess is "no".

Yes, you absolutely can use your sick days. And your employer absolutely can fire you for doing so.

You shouldn't plan a trip until you know that you will be able to use your vacation days when you go away.
