I posted this a few hours ago but didn't receive the right kind of answer back.
I got my phone confiscated yesterday at 2:00PM. It was the second offense [It was ringing]. I handed over the phone expecting to receive the phone at the end of the school day. I was informed that I must wait 24 hours and have a parent / guardian pick the phone up.
24 hours later I came hesitent to the office to pick the phone up. I'm an Entraprenuer and currently run my own buisness [Server management] and lost money, and also the phone is an RMA exchange through cingular and need's to be returned Or i will be billed for a new phone [500, treo 750].

Are they allowed to keep the phone under these circumstances?
My parents are currently out of town [seriously] for some family arrangement,[im currently 17, two months shy of 18]. and will be gone for the next 2 more days.

What should i do? Any help / legal refrence's [court cases] would be appriacted. THanks.

Yes, I do understand that they have the right to take the phone away [and have no problem with it] the fact is they should hand the student back the phone after school, when class is not in session. Just like going into a court. They check for knives, if you have it, they take it but when you leave they give it back to you.

And I don understand fully that cell phones are a distrubance to the class. There is no issues there.

Which school rule, the phone was clearly concealed in one's pocket, the only harm done that I see is a 'unpleasent' sound for five seccond while i madly rush to silence the phone/

Very ambiguous answer about why we should have a phone in class.
If i were a parent, i would definitely want my son to have a cell phone and be able to contact him if a 'family emergency' occurred. For example, his father died.

do the crime, do the time.

take it as a lesson learned. you violated the rules, reap the punishment for doing so. And its not like you didnt know it, since you were ALREADY disciplined for it at least once before.

Too bad; wait till your parents are back to collect your phone. And next time, just leave it at home. Why do you need a cell phone in school is beyond me, YOUR friends are already in school with you; talk to them there. Anything other contact from non-friends should be done AFTER School.

Now you're making excuses. Its not your position to argue the why of the rules; the RULES are clearly stated. CEL phones are a nuissance. when they ring, they interrupt others and the teacher. Also, the are prone to be high theft items , thereby schools dont allow them for the reasons that they dont want to be responsible for any theft of your property.

There is nothing ambigious about the rules of no cel phones. its clear as day.

the reason why that rule is in place is grounded in the 20 years they have been around. And their predecessors :pagers: that started it all. Blame the rich punk kids who went to school before you for making it difficult for you now.


Cel phone use are a privilege, not a right. And such privileges can be taken away when abused.

You violated school rules and no matter how you sugar coat or whine about it the bottom line is that the school has every right to hold the phone until a parent comes to collect it.

If you have a family emergency, your parents should call the school. By the way, it is extremely stupid to give your age online!

well idk if its legal or not, but at all the schools where i live you just give it to the teacher and pick it up at the office at the end of the day.
