This is a divorce situation.
My daughter's father keeps traveling thousands of miles away from where he says he is going to be while with my daughter. I never know where they will be. Last time he was going to be in Nevada and ended up in Texas. Now he is saying that he wants to travel to different countries too! He never informs me of where he is with her. What can I do?

I am primary parent, this happens during his visits with her.

I'm working with my attorney but trying to keep it to as little as possible because I cannot afford it.

Our paperwork says he must keep me informed of her location at all times and he chooses not to, but my attorney thinks he will just get a slap on the wrist and it won't be worth the cost of court. (at this time, but it may change with time)

I live in CA.

I am not sure what state you are in but in Texas the parent must notify the other when moving out of county or state. There is not a law in regards to vacations. I have found the below website very helpful in child custody matters.

I do know that a single parent CAN NOT get a passport of a child under 14 without the other parent being there in person.

Read your divorce papers and see if they stipulate out of state travel and any restrictions on it. For example, mine state that if either myself or my ex are going to leave the state for more that 48 hours, the other can request and expect to receive an itinerary with numbers where they can be contacted while gone. If your papers state this or something similar and it is not being followed, then you can take him back to court and have his custody revoked.

Well, it looks like he has custody.
Your going to have to go to court and have the visitations reviewed and changed so you will have him deliver her on your visits at the right time and date.

Just because he has custody and your divorced, doesn't mean he has to stay in one spot, as long as your getting your visits.

Go see someone at the court house.

Go to your lawyer with this immediately. He will file a contempt petition on your behalf. What your ex is doing is absolutely wrong and you must not allow it to continue. The Court will straighten his thinking and behavior quick!

Talk to your lawyer about your state laws.I know that in Georgia the other parent must have permission by the other parent before he/she can move.It sounds like he may take her away from you.Good luck.

i dont know for sure but i just read my friends divorce papers and it stricty says that neither of them can leave the state with the child. we live in CT. i dont know if its different for different states but i would look at your paperwork and/or call the court/lawyer. that REALLY doesnt sound right even if its not written out in your documents.

If this is when there is no school during HIS regular visitation---then he is doing nothing wrong...now if this is pulling her out of school...yes..report this to your attorney
