I'm near the end of a divorce, but I filed this years taxes as single, and my payroll still says married, can I change that or do I have to wait until the divorce is officially finalized?

I am an accounting major that has done taxes for the last seven years. Legally, you can file single on your W4's even when you are married. The question is when to file single on your 1040's. The question to that is simple, the law states that if you have been seperated for six months out of the year you are considered to be single for filing your tax return.

You should not have filed your taxes this year as single because you are still legally married. You've already committed fraud. You can and should change your status WHEN YOUR DIVORCE IS FINALIZED. UNTIL THE JUDGE SIGNS THAT DECREE, YOU ARE STILL LEGALLY MARRIED.

When it come to taxes you could do whatever you want.
I don't think it woulk hurt anything.
