If the phone is still being paid you will have no problem. Cingular will not shut the phone off if you do not sign a new contract you will just continue to pay you bill with no contract. Having no contract gives you a lot of room with your carrier, you can upgrade at anytime, and recieve the 2 year upgrade price for the phone.
And should you want to move carriers the number could still be kept your mother would just have to call in to Cingular and give permission for someone to take the line to another company and then with no contract you could cancel for no cancelation fee. That would be for the phone with no contract though because all phones have their own contracts.

Unless things have changed recently, Cingular will allow you to continue on at the end of the contract at the same monthly price. The contract end just means you are now free to change to a new contract if you so desire to . However, your best bet would be to contact Cingular directly to get confirmation.

Yes, you can keep your service going as long as you keep paying the same amount. The point of a contract, for the consumer, is to get new phones every two years at a discounted price.
