I would say that Chinese people know the rules regarding copyrights the way that the average person in America might know the rules regarding using profanity - it's about the same to them. Not something that you should do, but the rules are commonly broken anyway. Part of the problem would be that the rule has only recently been heavily enforced, and that although they know that it's not allowed, they don't know exactly what it is that they're doing and why it's wrong. The people that traffic and sell these things aren't educated, and only know that it's going to make them money. Their breaking of the law isn't a deeply evil thing in intent, it's simply another business that happens to be toeing the line with the authorities.

Yes, you are indeed infringing upon the copyright! You MUST get permission to use it. It doesn't matter that you moved it up or down any interval, OR changed the instrumentation. You have created a 'derivative composition' which is a work that merely changes part of another work, or "derives from". Note: I frequently analyze music for several large firms with questions about copyright infringement. I do a complete analysis, harmonic, lyric, and rhythmic. You'd be amazed at what constitutes a copyright violation. What you describe IS a violation.

no, they do not understand as a cultural issue. this is not an east versus west thing, but rather based on communism form of government. communism ideology does not recognize intellectual rights, as that is a kind of 'property' right denied by law. the USSR also did not recognize intellectual rights, and the theft of movies produced by Walt Disney is the reason that Nikita Kruchev was denied access to Disneyland on his USA tour. the "new" Russia is a member of the Berne Convention, so that rights, particularly to music compositions have been restored to its national composers by the Urugary Round Agreements. China is not a Berne Country, but all participants in the World Trade Organization, of which they are struggling to become a member, must recognize the rights that are held by their trading partners. Thus China must uphold US copyright protection in their country or be subject to discipline or ejection from the WTO. As public policy the Chinese government is trying to stem the proliferation of copyright theft, while at the same time it denies such rights to its own citizens. good luck.

Honestly, I don't think they were recognizing copyright rules.. that is, until they began manufacturing souvenirs for the 2008 Olympics to be held in Beijing. Oh, now, they get it about copyrights because they are cracking down on anyone who tries to manufacture Olympic memorabilia without their consent.

I don't think so, since imitation products and piracy are widespread in China. They copy everything, from bags, shoes, cellular phones, MP3 players, and even cities! There's actually a Shanghainese suburb that looks like an English Town. It has even a bronze statue of Winston Churchill.
P.S. On second thought, maybe they do understand the rules... but they still keep breaking it.

yes, chinese understand the rules of copyrights.
but chinese have to ignore it to earn a living.
do other people know the country's law about drugs? and why did they ignore it? because to earn a living right? its the same point.

Rules only works for the law abiding and god feaing. The others will bend and break them indiscriminately, especially when they are blinded by the $$ sign.

they understand... dvd shops here are warned of police raids and they hide everything out the back...which ur still invited to go go see and purchase.
