Anyone can get bail if a judge or magistrate sets bail for a particular criminal. If the judge or magistrate does not set bail for someone, then that person does not get bail. Most judges and magistrates will give bail if they have a strong feeling the criminals will return to the court instead of running away and not returning to court. People who have a tendency of running away and not showing up for court dates would not have a chance for bail.

So, the bottom line is that the judge determines who gets bail and who does not.

Suspects who are being tried for minor offenses and those where evidence is not strong can post bails under the applicable provisions of the Rules of Court.
