if someone is charged a misdemenor of embezzelment. offense carries charge of up to one year in jail and/or $2,000 fine or 3x times the amount stold. this is this person 1st offense on anything. what will happen? the attorney said possibly probation and community service plus paying back amount of stold merchadise. also this was a person stealing products from employer. honest serious answers only. person is working 2 jobs right now, is married and has a child.

I believed the attorney is talking about

Sec. 174.

(1) A person who as the agent, servant, or employee of another person, governmental entity within this state, or other legal entity or who as the trustee, bailee, or custodian of the property of another person, governmental entity within this state, or other legal entity fraudulently disposes of or converts to his or her own use, or takes or secretes with the intent to convert to his or her own use without the consent of his or her principal, any money or other personal property of his or her principal that has come to that person's possession or that is under his or her charge or control by virtue of his or her being an agent, servant, employee, trustee, bailee, or custodian, is guilty of embezzlement.

(3) If any of the following apply, the person is guilty of a misdemeanor punishable by imprisonment for not more than 1 year or a fine of not more than $2,000.00 or 3 times the value of the money or property embezzled, whichever is greater, or both imprisonment and a fine:

(a) The money or personal property embezzled has a value of $200.00 or more but less than $1,000.00.

On the appearance of it, it seem that most likely a fine or paying back the amount and community services will suffice especially if your employer willing to put up a good statement as regard to your working performance. My suggestion is to speak to your employer and seek their forgiveness and express your regret. Their testimonial in the prosecution will prove vital for you.

However, I do not understand why it is not charge under theft instead in embezzlement but you did not provide enough facts too. Find a lawyer if possible especially a good one to help you.

these questions are extremely specific and you would need a lawyer to answer them. It will depend on a variety of factors including state law and even the personality of the judge he is in front of.

Theft is theft!

It'll be a miracle if he doesn't get fired.
It would be up to the co to press charges,and up to the judge to sentence.

In reality, the co would give him the option, resign or be prosecuted.

It is "stolen" not "stold". But you hang in there and you just might make it in life.
