I was cited for crossing a double yellow line while passing another car on a two lane highway. I did start to pass this vehicle before the solid yellow lines appeared. Halfway through my pass a CHP was coming around the next curve. Within 2-3 seconds i was clear to pass car safely and did so. No sooner than i completed my pass, the CHP had quickly pulled off the side of the road. As I and the other car passed him sitting on the side of the road, he spun his cruiser around and cited me. His word against mine. The only solid double line I crossed was when I was pulling into my lane after i passed the other car. Any advice?

The way I understand it is you have to do the entire passing in the area where there is no solid lines. I'm probably wrong, but check and see.

You took so long to pass the other car that you were in the double line area before completing the pass. That is an unsafe passing maneuver and that is why you were cited.

Your word, a cited motorist trying to get out of a ticket, against the trooper, an experienced, trained professional.

Crossing the double yellow line is a violation of CVC 21460(a) ...

IOt doesn't matter whether you were passing or not - you were in violation of the VC.

You can not cross double yellow lines at any time.
